Terms of Service

These terms govern access to and use of BrokerWise, including the website, member workspace, AI tools, document knowledge features, support tools, billing features, and related services.

1. Agreement to these Terms

By accessing or using BrokerWise, you agree to these Terms of Service. If you use BrokerWise on behalf of a brokerage, company, team, or other organization, you represent that you are authorized to accept these terms on that organization’s behalf.

2. BrokerWise services

BrokerWise provides an AI-powered operations workspace for real estate brokerages, teams, agents, and staff. The platform may include agent support tools, document and PDF knowledge, internal support tickets, policy guidance, workflow tools, admin oversight, team access controls, usage tracking, billing tools, and related features.

3. Account eligibility and launch regions

BrokerWise is currently intended for users and organizations located in the United States, Canada, and the United Kingdom. We may refuse, suspend, limit, or terminate access where use is outside supported regions, where required by law, or where use presents operational, compliance, fraud, billing, or security risk.

4. Accounts and authorized users

You are responsible for maintaining accurate account information, controlling access to your workspace, and ensuring that only authorized users access your account. You are responsible for activity that occurs under your account, including activity by owners, managers, agents, staff, contractors, and invited users.

5. Brokerage content and uploaded materials

You may upload or provide documents, PDFs, policies, SOPs, contracts, onboarding materials, transaction notes, support records, and other brokerage content. You represent that you have the right to provide that content to BrokerWise and to use it within your workspace.

You retain ownership of your brokerage content. You grant BrokerWise a limited right to process, store, transmit, display, index, and use that content as needed to provide the platform and related services to you.

6. AI-generated output

BrokerWise uses AI systems to help answer questions, summarize documents, draft content, organize information, and support workflows. AI output may be inaccurate, incomplete, outdated, or unsuitable for a specific transaction, jurisdiction, client, listing, or brokerage policy.

You are responsible for reviewing AI output before relying on it, sharing it, sending it to clients, using it in marketing, using it in transactions, or using it for compliance-sensitive decisions. BrokerWise does not replace professional judgment, legal advice, brokerage supervision, compliance review, or licensed professional review.

7. Real estate, legal, financial, and compliance use

BrokerWise is an operations and information tool. It does not provide legal advice, financial advice, tax advice, brokerage supervision, transaction approval, compliance certification, or professional licensing services. You are responsible for following applicable real estate laws, fair housing rules, advertising requirements, privacy laws, brokerage policies, MLS rules, association rules, and professional obligations.

8. Acceptable use

You agree not to use BrokerWise to:

  • Violate any law, regulation, contract, brokerage policy, MLS rule, or third-party right.
  • Upload content you do not have permission to use.
  • Submit sensitive personal information unless you have authority and a valid operational need.
  • Attempt to reverse engineer, scrape, overload, attack, or disrupt the platform.
  • Use the service to create unlawful, deceptive, discriminatory, harassing, or abusive content.
  • Bypass access controls, billing controls, geographic restrictions, or security protections.

9. Subscriptions, billing, and payment

Paid plans are billed according to the plan, billing interval, seat limits, usage limits, and pricing shown at checkout or in your account. Payments may be processed by third-party payment processors, including Stripe. By purchasing a paid plan, you authorize payment of applicable subscription fees, taxes, and other charges.

Unless otherwise stated, subscription fees are billed in advance and are non-refundable except where required by law or expressly agreed in writing. If payment fails, we may suspend or limit access until payment is resolved.

10. Plan limits, usage, and storage

Plans may include limits on seats, AI credits, storage, document usage, support access, workflow usage, and other platform features. We may enforce, update, or adjust limits to protect platform reliability, control abuse, and maintain service quality.

11. Cancellations

You may cancel your subscription through the available account or billing tools, or by contacting support where self-service cancellation is unavailable. Cancellation stops future renewal charges but does not automatically refund prior charges unless required by law or expressly agreed in writing.

12. Privacy and data handling

Our handling of personal information is described in our Privacy Policy. By using BrokerWise, you acknowledge that we may process account, usage, billing, support, and workspace information as described there.

13. Third-party services

BrokerWise may rely on third-party services for hosting, payments, email, analytics, AI processing, storage, security, or related operations. Third-party services may be subject to their own terms, privacy policies, security controls, and availability.

14. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect the platform. No internet-based service can be guaranteed to be completely secure. You are responsible for using strong passwords, limiting account access, reviewing user permissions, and promptly reporting suspected unauthorized access.

15. Service availability and changes

We may modify, suspend, restrict, or discontinue parts of BrokerWise at any time. We may update features, pricing, plan names, usage limits, integrations, and workflows as the product evolves.

16. Intellectual property

BrokerWise, including its software, interface, workflows, design, branding, documentation, and platform materials, is owned by BrokerWise or its licensors. You may not copy, sell, resell, sublicense, or exploit the platform except as allowed by these terms.

17. Disclaimers

BrokerWise is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and error-free service.

18. Limitation of liability

To the maximum extent permitted by law, BrokerWise will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business, or transaction losses. Our aggregate liability for claims relating to the service will not exceed the amounts paid by you to BrokerWise in the three months before the event giving rise to the claim.

19. Termination

We may suspend or terminate access if you violate these terms, fail to pay fees, create security risk, misuse the platform, violate law, or use the service in a way that may harm BrokerWise, users, third parties, or platform reliability.

20. Updates to these Terms

We may update these Terms from time to time. The effective date above reflects the latest version. Continued use of BrokerWise after updates means you accept the updated terms.
